Lying about Rape and Profiting From It


Ten years ago 16-year-old Brian Banks was accused of rape. He pleaded no contest and spent five years in prison.

Recently, he was contacted by his accuser, Wanetta Gibson, who told him in two meetings that she wanted to recant her accusation. She was willing to explain that, ten years ago, she had lied about a consensual sexual act.

The Washington Post reports on what happened next:

In two meetings, she said she had lied and offered to help him clear his name, but there was a catch. She did not want to return a $1.5 million payment from a civil suit brought by her mother against the Long Beach schools.

She refused to repeat her new story to prosecutors but they accepted the account which had been secretly videotaped by the defense.

It was uncertain whether Gibson will have to return the money and unlikely she would be prosecuted for making the false accusation so long ago.

The court exonerated Banks, ordered his electronic monitoring bracelet removed, and declared that he was no longer a felon.

I don’t know the legal issues here, but it offends everyone’s sense of justice that she is allowed to keep the money she obtained under false pretenses. It is also profoundly offensive that she will not be punished for what she did.

Gibson is not just getting away with having taken years from a young man’s life. She was rewarded for it. And she believes that she should not have to give up her reward.

Clearly, something is wrong with this picture.

Most women do not lie about rape. Unfortunately, some do. Those who do not lie deserve justice, but so do those who do.

    Of course she didn't want to give the money back. What are the odds she still has any of it? Heck, five will get you ten part of this is an attempt by her to roll the dice again, and maybe get an other million from a book deal. It's not like she's worried about being punished...

    Even worse then you write. We all know that men get raped a LOT in prison, a point our Democrat leaders seem proud of. So not only did he get jailed for a lie, he was probably raped more then a dozen times, and we all know he won't be getting any "one and a half million" payoffs. Sigh. So it goes.

  3. I think you are going to find that the number of women who lie is a lot higher than you think. Think Duke rape case, Twana Brawley, et al. But this is what happens when, in the case of rape, one is denied their 6th Amendment rights because they are male in this society. Also how in the world did he get advised to plead no contest? I am trying to remember when DNA testing came to be used a a matter of fact?
    Suffice it to say, it is the criminal justice system that is the real culprit here. When the system can find ever more sophisticated reasons for denying people, especially men, there Constitutional rights we all have a problem. I enjoy teaching, but would not go near a public or private school in this country because some 13 year old girl could ruin my life and I have no defense. Even if exonerated one still will have the scarlet letter firmly affixed.
    Even when I taught privately I only once, and that was reluctantly, took a female student. I cannot be the only male who made a conscious decision like this one.

  4. If like many (if not most) new prison inmates, this man was raped in prison at least once within the statute of limitations. He should be able to at least recover civil damages and the state would best be served by vigorously prosecuting the liar as a rapist and insisting on the maximum penalty.
